The Durham Agricultural Fair Association, Inc. of Durham, Connecticut formed the Durham Fair Foundation, Inc. in 1996. The Foundation is organized under the auspices of the Internal Revenue Service as a 501c(3) organization. That means its activities are exclusively charitable, educational, or scientific. The Fair Association is an agricultural organization under section 501c(5). The primary and practical difference between the two organizations is that gifts to the Foundation may be tax deductible as donations for the donor while gifts to the Fair Association are not.
The Foundation’s Certificate of Incorporation states, in part, that the Foundation, “shall at all times be limited to operating exclusively for the benefit of, performing the functions of, or carrying out the purposes of the Durham Agricultural Fair Association, Inc.” This statement has resulted in the Foundation sponsoring exhibits and demonstrations during fairs as well as seminars at other times, including three in 2010, two concerning the growing of giant pumpkins and one featuring canning. The Foundation also acts as the charitable arm of the Durham Fair Association with funds provided by the Association in 1998, 1999, 2006, 2007, 2009 and 2010.
